Fitcheck Studio — Terms of Use

These Terms of Use ("Terms") govern your use of Fitcheck Studio, an AI-powered outfit analysis app for iOS, provided by Vision Lab ("we", "us", or "our"). By downloading, installing, or using Fitcheck Studio, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Fitcheck Studio, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the app.

2. License Grant

Subject to your compliance with these Terms, Vision Lab grants you a limited, non-exclusive, non-transferable license to use Fitcheck Studio on iOS devices. Free users receive 2 complimentary outfit analyses. Continued use requires an active subscription or purchase of additional checks.

3. License Restrictions

You may not:

• Copy, modify, or distribute the app
• Reverse engineer, decompile, or disassemble the app
• Remove or alter any copyright notices or proprietary labels
• Use the app for any illegal purpose
• Attempt to circumvent usage limits or subscription requirements

4. Subscription Terms

Fitcheck Studio offers auto-renewable subscription plans. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel subscriptions in your App Store account settings. Current pricing is available in the app and on the App Store.

5. In-App Purchases

Fitcheck Studio offers one-time check packs as in-app purchases. These provide additional outfit analyses that do not expire. All in-app purchases are processed through the Apple App Store. Current pricing is available in the app and on the App Store.

6. User Content

By uploading outfit photos for analysis, you grant Vision Lab a non-exclusive license to process, analyze, and store these images solely for providing the service. You retain all ownership rights to your photos. We do not use your images to train AI models or share them with third parties.

7. AI-Generated Content

Outfit feedback, styling tips, and recommendations are generated by artificial intelligence. While we strive for accuracy, AI-generated content is provided for entertainment and general guidance only. We make no guarantees about the accuracy, completeness, or suitability of AI recommendations for any particular purpose.

8. Acceptable Use

You agree not to upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable. We reserve the right to refuse service and terminate accounts that violate these guidelines. Our content moderation systems may automatically flag or reject inappropriate content.

9. Data Deletion

You may delete your analysis history within the app at any time. Upon account deletion or request, we will delete your personal data in accordance with applicable data protection laws. Some anonymized, non-identifiable usage data may be retained solely to enforce usage limits and improve app stability. This data is not used for tracking, profiling, or marketing.

10. Service Availability

Fitcheck Studio relies on third-party services including Supabase (data storage) and OpenAI (AI analysis). These services may experience downtime, outages, or degraded performance beyond Vision Lab’s control. Vision Lab does not guarantee uninterrupted or error-free service availability. No refunds or credits will be issued for temporary service interruptions caused by third-party outages. Vision Lab will make reasonable efforts to restore service promptly when disruptions occur.

11. Warranty Disclaimer

THE APP IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES OR GUARANTEES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

12. Limitation of Liability

IN NO EVENT SHALL VISION LAB BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE APP.

13. Software Updates

Vision Lab may provide updates, bug fixes, or new features to Fitcheck Studio. Updates may be provided automatically through the App Store. We reserve the right to modify or discontinue the app at any time.

14. Termination

We reserve the right to terminate or suspend your access immediately, without prior notice, if you violate these Terms. Upon termination, you must cease all use of the app.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified through the app. Your continued use of Fitcheck Studio after changes constitutes acceptance of the new Terms.
